GENERAL CONDITIONS OF SALE


These General Conditions of Sale govern the supply of products and services through this site. For the purposes of the conditions of sale, the seller is:

Acceptance

Only persons with full legal capacity can complete an order for products on the site ("Order").
Please read these General Terms and Conditions of Sale before completing your order.
The Seller reserves the right to update, modify or alter the content of these General Conditions of Sale at any time. The version of these General Terms and Conditions of Sale that is published on the site at the time the Order is sent will be the version applied to that Order.

Products

All products published on the site are subject to availability. The products are not intended for resale.

The Seller makes every effort to ensure that all information published on the site, including product descriptions and prices, but not limited to these, is accurate at all times. In the unlikely event of errors in the information published on the site, the Seller will try to resolve any problems promptly.

The images, drawings and photographs published on the site are for illustrative purposes. Since there may be occasional small discrepancies between an image or photograph of a product and the actual product (for example, in regards to the colors of the product), we recommend that Customers examine the descriptions carefully to better understand the characteristics of each product. .

Orders

The Customer must carefully read the instructions on the site before completing the Order. Customers must correctly fill in all mandatory fields during the checkout process necessary to complete the Order. The personal data provided for the completion of the Order must be correct, accurate and current in all respects.

The Customer can decide whether to register on the site or, alternatively, complete the Order as an unregistered user (guest).

Sales

By submitting an Order, the customer sends the Seller a proposal for the purchase of products on the site. The Seller reserves the right to accept Orders at its discretion.

The Seller may decide to refuse an Order, for example, when delivery to the destination indicated in the Order is impossible, or when the Seller suspects fraudulent activity.

The Seller immediately sends an email to the user to confirm receipt of the Order ("Order confirmation email"). This email does not in any way constitute acceptance of the Order by the Seller.

The customer is invited to verify the truthfulness and accuracy of the information contained in the email confirming receipt of the order and to promptly notify the Seller of any errors. Depending on the case, any additional costs necessary to process the Order and due to the inaccuracy of the information provided by the Customer could be separately attributed to the same customer.

The sales contract between the Seller and the Customer is considered completed only and exclusively when the customer receives a confirmation email from the Seller, in which the customer is informed that the order has been sent ("Shipping confirmation email" ).

The shipping confirmation email contains all the essential data of the Order, including but not limited to the list and price of the products purchased, any shipping costs, all the information necessary to identify the customer, the delivery address. The Shipping Confirmation Email also includes a unique numerical identifier for the Order, which the Customer must mention in all communications with the Seller's Customer Service.

Prices

The prices of the products are indicated on the product pages of the site, during the checkout procedure and in the order confirmation email.

Shipping costs are communicated to the customer at checkout and are shown once again in the order confirmation email. Shipping costs may vary depending on the delivery destination, delivery method or other factors.

Any price changes only apply to Orders placed after the publication of the price change and do not act retroactively. The Seller reserves the right to cancel an Order due to an error in the price published on the site or indicated in the email sent to confirm receipt of the Order.

Taxes and Duties

Orders delivered within the European Union are inclusive of VAT.


Invoices and method of payment

Payment for orders is made using the following methods:

• Credit card;

• Paypal;

• Google Pay;

• Apple Pay

The Seller charges the purchase only upon acceptance of the Order. Nonetheless, the Seller reserves the right to carry out security checks on the payment method chosen by the Customer or to request a pre-authorisation or to make an advance debit for precautionary reasons.

The Seller uses a primary payment gateway to authorize payments for all Orders. Therefore, the Seller does not directly manage the financial information relating to the payment method used by the Customer and the site does not process any information or financial data provided by the Customer.

To ensure the highest level of security, payment information transmitted over the internet is encrypted with SSL (Secure Socket Layer) technology. The data is transmitted in encrypted form using the SSL certificate and can therefore not be intercepted or used by third parties.

In the unlikely event of errors, negligence or unlawful acts relating to the handling of transactions associated with an Order by the payment portal and/or intermediary payment systems, the Seller cannot be held responsible for such error, negligence or unlawful act.

The Seller reserves the right to cancel an Order in the event that fraudulent use of the payment method used for the Order has been notified. Furthermore, the Seller will not be liable in the event of illegal use of a payment method by a third party which is not attributable to an error or negligence of the Seller itself.


Vouchers, gift cards and discount codes

During marketing campaigns, the Seller may issue vouchers and discount codes for the purchase of Products on the Site. These vouchers and discount codes cannot be combined and are not refundable under any circumstances.

Likewise, any gift cards issued by the Seller against the payment of a fee by the customer cannot be combined and are not refundable.

The gift card is valid for 12 months from its issue and can be used until the credit runs out or until it expires. It can be used as the only payment method or to complete another payment method. The gift card is not nominative and cannot be recharged.

Deliveries

The Seller ships the products without undue delay and, in any case, no later than 30 (thirty) working days from receipt of the Order.

Parcels are delivered by one of the main international couriers (the “Courier”). Delivery times vary according to the delivery destination and are in any case to be considered purely indicative. Delays in delivery may occasionally occur (for example, during the Christmas period or due to prohibitive weather conditions, strikes, etc.). No liability can be invoked against the Seller by the Customer or third parties in case of delay in the execution of the Order or in the delivery of products.

Deliveries are made only during working days, unless mutually agreed otherwise. Delivery of an Order is considered completed when the product has been made available to the Customer at the address specified in the Order or otherwise agreed between the Customer and the Courier.

In the event of non-delivery due to the impossibility of receiving the Order by the Customer, the Courier sends an email to inform the Customer and attempts to deliver the Order a second time.

If the new delivery attempt is impossible because the Customer cannot receive the Order again, the Customer Service contacts the Customer to provide further assistance on the Order.

If after 15 (fifteen) days from the date on which the Order is available for delivery, the Order could not be delivered for reasons attributable to the Customer, the Contract of Sale will be considered terminated, unless the Seller and the Customer have not agreed otherwise. In this case, the Seller will reimburse the Customer for all payments received. The Seller may decide to withhold part of the payments received to compensate for the logistics costs incurred in returning the Order.

The cancellation of an order will be notified to the Customer by e-mail. The refund will be credited to the Customer through the payment method originally used by the Customer for the Order.

Further delivery attempts can be agreed, at an additional cost, between the Seller and the Customer.

Upon delivery, the Customer is invited to carefully check the condition of the products and packaging and the correspondence of the number of items/packages delivered to the information contained in the transport documents. In the event of anomalies, the customer is required to collect the goods with specific reserve, detailing the reasons for the same (eg: "damaged package") on the waybill, then proceeding to promptly inform us via email at the following email address: customer.service@ tvs-spa.it. Reports received more than 5 days after receipt. After this date, any claims for damaged goods will not be accepted. Complaints must absolutely be accompanied by photos proving the actual damage to the packaging and/or the items concerned.

Right of withdrawal and replacement of the product

Within 14 (fourteen) days from the date of delivery of the Order, the Customer has the right to exercise the right to withdraw from the Sales Contract without any penalty and without having to indicate the reason.


TVS grants the right to evaluate and accept any replacement requests from the Customer received after the legal terms of 14 (fourteen) days and in any case no later than the maximum term of 30 (thirty) days from the delivery date.
To verify compliance with the above term, only the delivery date of the products shown in the courier's tracking system, when available, will be taken into account.
The Seller only accepts the return of items that have not been used, that are not worn or worn, stained or damaged, and that do not have defects or imperfections not attributable to production.
Any missing or damaged products during shipping must be reported immediately to customer service. Claims for missing or damaged goods received after 5 days of receipt of the goods by the customer will not be accepted. These complaints must be accompanied by photos proving the actual damage to the packaging and/or the items concerned.
Products made to order or clearly personalized cannot be returned or exchanged.

If the Customer decides to request the replacement of a product or to exercise the right of withdrawal, he must first notify his intention to the Seller using the procedure indicated on the site. The Seller only accepts the return of products purchased on the site.

Once the requirements for replacing a product or for exercising the right of withdrawal have been verified, the Seller notifies the Customer of acceptance of the return and proceeds with the replacement of the product or, in the event of withdrawal, with the refund of the purchase price and any shipping costs incurred by the Customer for the initial shipment.

The Customer must return the products to the Seller within 14 (fourteen) days of informing the Seller of his intention to cancel the Order or replace the product. The Seller carries out the refund procedure within 14 (fourteen) days from the date of receipt of the returns, or from the date on which the Customer has demonstrated that he has returned the products, whichever comes first. If no product(s) has yet been shipped by the Seller, the refund will take place within 14 (fourteen) days from the day the Seller was informed of the Customer's decision to cancel the Contract.

Refunds will be paid by the same method used by the Customer to complete the Order.

If the Customer has returned the products without having the right of withdrawal or to replace a product, the Seller will not accept the return. If authorized by the Customer, the Seller sends the unlawfully returned product back to the Customer and charges the related shipping costs to the Customer.

In the event of multiple returns by the same Customer, the Seller reserves the right not to accept further Orders from the interested Customer.

Warranty

The seller assumes responsibility for any original defect of the products.
The Seller warrants that the Products are free from faults, defects and imperfections and that they comply with the provisions of the Sales Contract. In particular, it guarantees that the products:

• they are suitable for the use for which they are normally to be used;
• conform to the description or possess the qualities presented on the site;
• offer the usual qualities and performance of goods of the same type;
• are suitable for the particular use desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller.

Any marginal differences between the description of a product on the site and the actual characteristics of that product cannot be considered as legitimate reasons for a non-compliance claim under current law.

In the event that a non-compliant product has been delivered, the Customer may request that it be brought back into conformity, at no cost to the customer, by repair or replacement. If this is not possible, the Customer will be entitled to a reduction in the price, or a full refund of the price, and (if applicable) of the delivery costs.

The mere fact that the Seller accepts that the Customer returns a product for verification of product conformity does not imply acceptance by the Seller of the Customer's claim of non-conformity of the Product. Indeed, the Seller reserves the right to personally check whether the product complies with the Sales Contract once the product in question has been received by the Seller.

Users are invited to carefully read the privacy policy posted on the site to understand how their personal data is treated and to learn more about their data rights.

Customer comments and complaints

Any comment, suggestion or complaint from the Customer to the Seller in relation to an Order must be presented to the Seller through the appropriate contact form or by email by writing to: customer.service@tvs-spa.it
